What’s The Difference Between TREC & Texas REALTORS®

The main difference is that 

TREC is a mandatory state government agency that licenses real estate professionals, while Texas REALTORS® is a voluntary professional trade association that provides extra tools and status to its members. 

Texas Real Estate Commission (TREC)

TREC is the regulatory authority for the state. Every person who wants to legally practice real estate in Texas must be licensed through them. 

  • Role: Licenses and regulates brokers, sales agents, inspectors, and appraisers.
  • Authority: Enforces The Real Estate License Act (TRELA) and can fine, suspend, or revoke licenses for rule violations.
  • Forms: Provides approximately 27 promulgated contract forms that are legally required for most residential transactions.

Texas REALTORS® (formerly TAR) 

Texas REALTORS® is a private trade association (the state-level affiliate of the National Association of REALTORS®). You do not need to be a member to have a real estate license. 

  • Role: Provides advocacy, education, and legal resources to help its members succeed.
  • Ethics: Members must adhere to a strict Code of Ethics that goes beyond the minimum legal requirements set by the state.
  • Forms: Offers more than 150 exclusive forms (like listing agreements and leases) that are not provided by TREC and are available only to members.
  • Membership: Voluntary. Only members of this association can legally call themselves “REALTORS®”.
